PepsiCo Frito-Lay Loses Sole Rights of Unique Potato Variety of India

The company ‘PepsiCo Frito-Lay’ has recently lost the company’s exclusive rights to a unique variety of the potato after the authorities of India has ruled that, the US-based company ‘PepsiCo’ cannot claim a patent over the potato variety.

The PPV&FR (Protection of Plant Varieties and Farmers’ Rights) Authority of India has rejected a patent, which has been held by PepsiCo for the variety known as FC5 potato, which was grown in the state of Gujarat, India.

The company ‘PepsiCo’ has built the first potato chips manufacturing facility in India in the year 1989, and has developed the FC5 potato variant, which has been also known as the FL 2021, and the potato is having lower moisture content, which is responsible for making the potato ideal for the manufacturing of the potato chips.

The company has registered the variety in the year 2016 and it has also been supplying the FC5 seed to the local farmers, who are in turn are selling their potatoes to the company at an already fixed price.

Although, some of the farmers have started growing the variety of FC5 potato on their own, which has then resulted in the purchase, and the company has taken the farmers to the court in 2019 over the alleged infringement of the patent, and later the company has dropped all the law suits for the purpose of settling the case. The company has also started built a potato chips facility in Odisha, India for the purpose of promoting the potato variety called as Chipsona.
