European Union Proposes Rules to make it Easier to Sue AI Systems, Drone Makers

The European Commission proposes new rules to make it easier for consumers to claim compensation from manufacturers of drone systems, artificial intelligence (AI) if they have caused them harm.

The aim of the AI Liability Directive is to provide more legal clarity for consumers and manufacturers as the use of Artificial Intelligence (AI) grows exponentially. Didier Reynders, commissioner for justice, said that while considering the large potential of new technologies, they must always ensure the safety of consumers.

Didier Reynders added that proper standards of protection for European citizens are the basis for consumer trust and hence successful innovation. New technologies such as drones and delivery services operated by artificial intelligence (AI) can only work when consumers feel protected and safe.

Under the new rules, the burden of proof in cases of injury and damage caused by AI-enabled products will still be on consumers. But it will also be available with a so-called presumption of causality, which will address the difficulties experienced by the victims in explaining in detail how the harm was caused by a specific fault.

The new rules will reflect global value chains, while fostering innovation, and consumer trust, and provide strong legal certainty for businesses that are involved in the green and digital transition.
